Question: Can a fax copy or photocopy of an application be filed?

Answer:
You cannot transmit an application by means of facsimile transmission, i.e., by "faxing" it to the Office, but you can file a photocopy or a fax copy by U.S. mail or hand delivery.


Question: What constitutes interstate commerce?

Answer:
For goods, "Interstate commerce" involves sending the goods across state lines with the mark displayed on the goods or the packaging for the goods. With services, "interstate commerce" involves offering a service to those in another state or rendering a service which affects interstate commerce.

Question: Is it advisable to conduct a search of the Office records before filing an application?

Answer:
Yes. You may conduct a search free of charge on the USPTO website using the Trademark Electronic Search System (TESS).
